Welcome to Fashnia. These Terms of Use ("Terms") apply when you access or use the Fashnia website and its related features and services ("Fashnia", "we", "us", or "our").

By using Fashnia, you agree to these Terms. If you do not agree with them, please do not use the platform.

1. About Fashnia

Fashnia is a fashion discovery platform and search engine designed to help people search across brands, discover fashion, save products, create collections and visit brand or retailer websites.

Fashnia is not a fashion retailer and does not normally process product purchases itself. When you choose to buy a product you have found through Fashnia, the purchase is completed with the relevant brand or retailer on their website.

2. Eligibility and accounts

You may use Fashnia only where you are legally able to agree to these Terms.

If you create an account, you are responsible for keeping your account information accurate and your login details secure. You are also responsible for activity carried out through your account.

If you believe someone has accessed your account without your permission, please contact us as soon as possible.

3. User content and activity

Depending on the features available, users may be able to create profiles, save products, create collections, follow accounts, comment and share or upload content.

You remain responsible for content you submit to Fashnia. You must have the right to upload, publish or share anything you make available through the platform.

You must not post or upload content that:

• is unlawful, fraudulent or deliberately misleading
• infringes another person's intellectual property or other legal rights
• is threatening, abusive, defamatory, obscene or seriously inappropriate
• contains malware, spam or material intended to interfere with Fashnia or its users

4. Brand pages and product content

Fashnia displays information about fashion brands and their products. This may include brand names, logos, product images, descriptions, prices and links to external websites.

Product and brand information may come from participating brands, retailers, authorised product feeds, affiliate partners or other permitted sources. Some brands may also manage or contribute directly to their presence on Fashnia.

Anyone who provides content directly to Fashnia is responsible for making sure they have the necessary rights and permissions to provide it.

5. External websites and purchases

Products on Fashnia may link to websites operated by brands, retailers or other third parties. Those websites are separate from Fashnia and are operated under their own terms, policies and practices.

We do not control those websites and cannot take responsibility for their operation, availability, products, customer service or policies.

If you buy something after leaving Fashnia, the transaction is between you and the relevant brand or retailer. Questions about orders, delivery, returns, refunds or product quality should be directed to the business you purchased from.

6. Intellectual property

Fashnia's own branding, design, software, original text, platform features and other material created or owned by Fashnia are protected by intellectual property laws.

You may use Fashnia for normal personal use, but you must not reproduce, sell, commercially exploit or substantially copy Fashnia's own protected material without permission, except where the law allows it.

Trade marks, logos, product images, brand names and other content belonging to third parties remain the property of their respective owners.

7. Acceptable use

Please use Fashnia in a lawful way and do not interfere with the platform or other users.

You must not:

• use Fashnia for unlawful or fraudulent activity
• pretend to be another person, brand or organisation
• misrepresent your relationship with another person or business
• attempt to gain unauthorised access to Fashnia, its accounts or its systems
• introduce malicious software or deliberately disrupt the platform
• use Fashnia to threaten, harass or seriously harm another person

8. Affiliate links and commissions

Some links on Fashnia may be affiliate links. This means Fashnia may receive a commission when a user follows a link and makes a qualifying purchase with a third-party brand or retailer.

Using an affiliate link does not change the price charged to you unless the relevant retailer specifically states otherwise.

9. Availability of Fashnia

We work to keep Fashnia available and functioning properly, but websites and online services occasionally experience errors, outages or technical problems.

We may also update, add, remove or change features as Fashnia develops. We cannot promise that every feature or part of the platform will always remain available.

10. Suspension and termination

We may restrict, suspend or close an account where we reasonably believe the account has breached these Terms, threatens the security or operation of Fashnia, or is being used for unlawful or harmful activity.

We may also remove user content where necessary to protect Fashnia, its users, third parties or legal rights.

11. Product information and disclaimers

Fashnia helps users discover fashion, but the product information displayed on the platform may ultimately come from brands, retailers or external data sources.

Prices, discounts, availability, product details and promotions can change after they appear on Fashnia. We therefore cannot guarantee that every product listing will always reflect the latest information.

Before making a purchase, you should check the relevant brand or retailer website. The price, availability and product information shown there at the time of purchase will apply.

Fashnia is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee that every piece of content on the platform will be complete, accurate or suitable for every purpose.

12. Liability

To the maximum extent permitted by law, Fashnia is not responsible for indirect or consequential loss arising from your use of the platform, your inability to access it, or a transaction completed with a third-party brand or retailer.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded or limited, including rights you may have under Australian consumer law.

13. Privacy

Our Privacy Policy explains how Fashnia collects, uses and handles personal information. By using Fashnia, you should also read that policy.

14. Changes to these Terms

Fashnia will continue to develop, so these Terms may occasionally need to change.

When we update them, the revised Terms will be published on this page and the "Last updated" date above will be changed.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, except where another law must apply.
